    Transfer of Claim after Discharg

    If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

    Aren't you guys an asset case? Is the trustee taking claims still? Or is that time passed and they are trying to sneak in and try to get paid?

    Just my ramblings first thing in the morning before any Dt. Mountain Dew.

      We are an asset cas, yes. We are still making payments to the trustee, but that will stop in April. Meanwhile, we were discharged on Aug. 13.

        I thought once you are discharged and as long as they were included on the BK that they cannot collect that debt from you anymore. Right??

          You are correct. But more and more, we--several other posters and myself--are seeing attempts by third-party Collections Agencies trying to circumvent the BK laws and trying to scare/bully the person into paying.

          I think in this case, that this is simply a notice to the court that these accounts have been sold. 'Hub and I will let you know if anything comes of it.

            It is certainly ridiculous that these accounts sell the debt to JDBs when they have been discharged. However, it appears that it is something that we all need to be more aware of.

            It seems that if you fight back with some of these, that they do back down very quickly, or so I hear. Still, it is not right.
