Ok, I don't know what cash advances are, but I know we've done 4 bank transfers in the last year and a half. My lawyer knew we had done a transfer just before filing, we did our last one on 3/6/08, we filed on 7/24/08, thats like 140 days before we filed. We sat and listened to the trustee ask people if they've done bank transfers in the past 90 days, we went up confident we hadn't, well, then we get up there and he doesn't say the 90 days part... we looked at the lawyer before saying yes. he gave us no nod or anything to say no, then he acts as if he had no idea we had any transfers, and then he asks us "are you that couple that switched from one account to another?", we looked at him, sort of shocked that we talked with him and gone over this only days before... so we just stood there, like idiots, until the lawyer answered for us.
The lawyer told him that the amount was switched from one account to another, and then back, and said this would equal 0. But my husband and I both know that isn't right, what the heck was my lawyer thinking?
Anyways our final transfer 140 days before we filed was from discover to capital one for $5800.00. How badly is this going to affect me? I have to get this info to the lawyer by friday so the trustee can have it by tuesday, we are sending him the info, of all four transfers we've done, (the first 3 were in feb, aug and nov of last year), tomorrow, so he gets it to the trustee quickly.
We aren't trying to hide anything, we weren't trying to ditch anyone. We stopped making all payments in April/May when the lawyer said we should. When we did these transfers, we did them for the purpose of lower interest and when you transfer you get excused a payment, so it's as if you get a month off from paying on it. But this didn't help, and we still had to file.
