    Chase Auto Finance...Motion to Lift Question!!

    I have an auto loan with Chase.

    I am currently 40 days past due. I always pay @ 29 days. I just realized that I am no longer able to afford that vehicle. At least my new budget says so.

    I spoke to chase and the lady mentioned not to worry about a repo, and to get the reaff into them by the last day of objections.

    On another phone call, she mentioned (out of the blue) if you want to keep the vehicle just keep making the payments. That was weird, and I feel she said that basically stating that I will not have to reaff and to continue payments.....Anyhow,......

    Does anyone know if I will need to see a "Motion for relief of stay" on pacer before I shoud worry about them repoing the car?

    I would worry they are lifting the stay to repo the car.

      If you are late, you are late. Unless you cure the default, they have the right to repo anytime after your BK is discharged.

        I agree with HHM. If you are late they have the right to repo. My attorney was very clear that if we wanted to reaffirm our cars the payments had to be up to date.
        8/5/08 - Filed Chapter 7
        9/10/08 - 341 Meeting - It went great
        11/10/08 - Last day for Objections
        11/12/08 - Discharged & Closed!

          If they plan to take it during the bk then yes they'd have to file that first.

          If you cannot afford the car I would not reaffirm.
          May 31st, 2007: Petition Filed by my lawyer
          July 2nd, 2007: 341 Meeting Held
          September 4th, 2007: Discharged and Closed.

            Thanks everyone. Yes, I was going to reaffirm and had it in the petition; however, I've come torealize, I cannot afford it right now.

            I will continue to check pacer, but I surely know that they will repo it after discharge.
