Yes. I shall pro se from now on. I actually caused a longer discharge trying to fire her, ergo I incurred longer time for response. After the fact, I have no malice. I would not use her again though. Thanks. 'Hub

We have a deposition this Friday in which we will plead the fifth ammendment as they put in writing years ago that they will attempt to take this to criminal. It is a long drawn story, that has brought us here to bk. Our AP trial will be January 9, and I intend to throw this case as in a Jury Trial if we go plead the fifth that would be tantemount to pleading guilty. Once that happens they will move this eight year old case to Criminal even though the S.O.L. is two years. They are Adversary Procedure against no debt, loan, lien, Judgment, and I can't see why the Judge is allowing it. I am Judgment proof but they will then tend to make writs of attachment and liens and harass me from then on. 'Hub

If the case was included in your bankruptcy isn't any debt discharged with it?

I'd take a copy of the bankruptcy court order with you and final decree and enter it into evidence especially if this guy was listed, it should have killed this lawsuit when you filed.

P.S. JR, we never went to trial, ergo, no lien, Judgment, damages, bills, loans etc. So they are filing AP on the come with anticipation of damage.

I listed mine and it went away......

Also if they made no claim against the bk estate, then you owe them nothing I think. Personally I'd look around for another lawyer and run this by them, it sounds like you are getting the run around.
