    Motion to Approve

    As part of our Ch 7 filing we agreed to assume our auto lease with Chrysler. The assumption was filed about 2 weeks ago, along with a motion to approve. So far we have not seen an order from the judge approving the motion. We are about 2.5 weeks away from discharge. I know I am being paranoid , but lets say our 60 days expired and the motion still hasn't been acted upon. Can this theoretically hold up discharge? We only have on flag in Pacer, and that is from the notice of appearance when the attorney for lease company filed it back in July.

    Laura, for what it's worth, I never did see a motion to approve, but my discharge came through last week anyway. Good luck!

      By assume do you mean reaffirm?

      Has the judge scheduled any hearings on the matter?

      If nothing on PACER might be time to call the lawyer
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

        Thanks Woodsprite. We have a motion to approve but the judge hasn't acted upon it yet.

        JRScott - You don't reaffirm a lease per se. Leases work a little different..you either assume or reject a lease. So I don't believe the same hardship rules apply as they do with a reaffirm. There are no hearings scheduled according to Pacer

          For what its worth, ours is an asset case and there is administrative stuff going on with it, including a motion, but we were discharged on Aug. 13, 2008. The thing that held us up was the lack of a copy of our marriage license in our paperwork.

            I didn't know leases different

            Might still call the lawyer and check

                Just wanted to update, spoke to our lawyer and a motion to approve an assumption of lease agreement has a 20-day objection period, so we should be seeing the court's approval sometime this week.
