Student loan question

Ok so DH and I will be filing chapter 7, we are meeting with our lawyer on thursday to get everything in order with him. I have a question about a student loan. When I first went to college I wasn't married and my mom took out a student loan in her name for me, with the agreement that I would be the one making the payments. I am in no way on this loan at all, it is only in my mom's name. My question is since I've been making the payments but the loan is in my mom's name, will this affect our bankruptcy case? I will be sure to ask the laywer about this on Thursday, but until then I'm going to be worrying about it. Thanks!

Since you have no legal obligation to pay the loan, it won't affect your bk except, you may need to delay your filing to prevent any recent payments you made to mom from becoming a preference issue.

I am making payments directly to the bank and not my mom, don't know if that makes a difference or not.
