Wife refuses to go BK-doing it on my own... house question

    I was told that BOA can't touch your checking if you default on your CC.

    My wife has a CC with BOA. Our home loan is with Ditech (a GMAC company). Our car loan is with Suntrust Bank and GMAC.

    I have a BP gas card. Do you think I should include it in the BK? Won't they close the account on me anyway once they see I am filing?

      In BK you have to list all debt.

      Most likely they'd cancel the card anyway. If the balance is 0 you don't have to list it but keep in mind it most likely will not survive the bk.

        I'll include it then. We've been using this card to put gas and buy food since we have no other money left.

        She agreed to go with me on the 15th to pay the retainer fee. I think once she speaks to the lawyer face to face, then maybe they will talk some sense into her.

        Once we sign the retainer, we will have to stop making all payments to non-secured debt that we have not used. Most of our credit cards are used regularly as it's impossible to live without them at this point. We need food and gas and can't do without it. We charged our car insurance on the AMEX card a couple weeks ago.
