    Very quiet on the Trustee front...worried

    Okay we are about 2 weeks away from our discharge date of 10/21/08. We have heard nothing from the Trustee in terms of more questions or any further information. We are giving up two homes and two cars. We have no other real assets. We check our pacer acct every few days.
    The last thing that was posted was:

    Meeting of Creditors Continued on 10/21/2008 at 10:00 AM. Section 341 Meeting of Creditors held on 9/23/2008. Tape Number: 14. Notes: Amendments, current tax returns (Entered: 09/24/2008)

    This is our second continuance regarding our tax returns...all the trustee said was that he needed a copy of our 2007 returns which we provided through our attny on 9/23. Since then the above posting is the last that we heard.

    It seem to be too quiet. Should we be worried? Should we still expect to be discharged around 10/21?

    Also we have not seen an NDR posted by the trustee...does that mean he can still change our case to an asset case?

    are there any flags on there you think may stop the discharge?

      no flags...just that last post regarding meeting of creditors on our discharge date.
      No other flags or messages or docs on pacer. Attny says everything is fine.

              You should be fine. If you are like me I knew in my heart there was someone sitting at a desk with a big ole' spot light shining on my paperwork just looking for a reason. Well I got news for you - aint happening! These Trustees are swamped with filings and the resources it takes to work on one file is huge.
              My Trustee wanted a few things from me early in the process and then it was quiet thereafter. Heck, they wanted to see the receipt for a stupid $27.00 newspaper bill I said my wife pays. I had the statement so I was clear. Can you say "they were looking for fraud"
              Like I tell others, if you have nothing to hide and upfront the whole time, why worry. It will be over before you know it!

                Thank you, I guess you have a point. It has been so quiet and no questions asked that the calm is really worrying us. We're keeping our fingers crossed.

                    Yeah, the last few weeks are the worst. I was becoming a Pacer junky

                    But as others have said, quiet is usually a good thing.
                    6/11/08 - Filed Ch. 7, Filed Pro Se, No-Assets
                    7/15/08 - 341 Meeting Held
                    10/01/08 - Discharged
                    10/08/08 - Case officially Closed!!

                      Your case should be discharged after 60 days from the date of your first 341 hearing. Our first 341 hearing was continued and we had many complications after our second, but we were still discharged on time. Focus on preparing for the second hearing. If the tax returns are the only reason for the continuance and you've provided them, you're in good shape. If the trustee gave you the impression from their questions that they were looking for something specific in those returns, I'd review them before the hearing for anything that stands out.
