    Taking my stuff?

    I am still as worried as before. I am still trying to sell what I can part with to come up with the money for an attorney. I stopped paying most of my bills now as well.

    I am worried about filing and having them take my stuff. I do not have much but what I have means a lot. I am under the median so what are the chances they will take my stuff?

    I am an artist besides my full time job. It would kill me if they took my art to sell off.

    I am soo depressed . I just cannot seem to be happy anymore and fear that I will not be able to file or come up with the money.

    Inpain66: The only way you are going to feel better is “bite the bullet” and DO IT. Sell your art yourself for the lawyer fee or go fill out an indigent form that waves some fees and go pro se. Check your states exemptions as to what to keep and also list your paints as tools of your trade, even if it isn’t your main job, if you make money off it, it is not hobby tools. There are plenty of site on the Internet that you can put down or take a means test. You said you met the means test so quit procrastinating. God helps those who help themselves.

    Suggestion, list you “Stuff” here and let the forum figure their worth for you. You would probably be happily surprised that you will be no asset case. ‘Hub

      If I can give you one piece of advice, try not to let your emotional health suffer over this, for this too will pass. Detach yourself from it. You are simply making a business decision as do the corporations of the world.

      I received a lot of good advice here so you are in the right place

      You will be happy again, it may take some time but you will. The process will be draining but try to see a light at the end of the tunnel, and come back here often with your questions or when you need understanding.

        We all go through the panic stage wondering where we will get the money for this and that. Is there and family or friends that might could gift you some money to help pay for the lawyer?

        Don't worry it'll get better.

          Sounds like you are going to have a straightforward Ch. 7, and you are worrying too much. Your occupational tools (tools of the trade) will very likely be covered by an exemption.

          Perhaps you should go ahead a meet with a lawyer if you have not already done so.

            There are plenty of exemptions that you can claim, so you will get some say in what you can keep. Many if not most chapter 7 cases seem to end up being no asset cases. Mine would have been, except that my business (the reason for my bankruptcy) had about 33,000 in inventory. That will not be exempt, but it seems that almost all of my personal stuff will be exempt, including my car, which is an older one, but paid for. I may lose the $5,000 that I have in a whole life policy, but I consider that a small sacrifice in the face of unmanageable debt.

            Being debt free will be life changing, and after months of trying to make it all work out, and now months of getting ready to file, if I had something that they wanted, I would probably hand it over without a lot of heartache. I know this isn't the case for everyone, and I am not trying to be insensitive, but I am asking to be relieved of over $70,000 in debt that I incurred while trying to start and keep my small business, and I try to keep things in perspective.

            You may feel much better after talking with a lawyer--I did.

              I agree...I would make sure you exempt whatever you can. Most exemption limits, I've found, are pretty generous.

              We actually had furniture that we bought 3 months prior to filing, still owed on it, and they STILL didn't come and take it.

              I know right now it seems like a bad situation, but this too shall pass...and when it does, you will be in a much better place.

                rooms to go

                We have already been to the 341 meeting and have no assets and only my husband filed as most of our debt is in his name only but there are 3 heavy burdens on our shoulders that we just can't seem to get answers for. !. Ford motor credit has our 2 car loans. They are in both our names and mine is first, our attorney is being vague about if we can keep the cars or not but I don't see how they can take them since I am not filing and they are both in my name first. Is this possible? WE have just received a reaffirmation hearing date for Nov 20th. NO clue what is to follow. Then the other thing that keeps me up all night reading this formum! haha is our Rooms to go furniture deal. Are they coming to get it? If so can they just show up or do they have to give me notice? Nothing has been mentioned on the Pacer, or the 341 meeting. We are suppose to be discharged near the 27th of October, which is today. We filed on the furniture as our attorney told us to chance it and see what happens. At this point I just want it over and they can have it if they want it. We have had it for 3 years and paid some one it because it was one of those buy now, pay later deals. I would appreciate any and all advice. I can not tell you how much I have learned on this forum already! Thank You all so much.
