    reaffirmations in a no asset ch.7

    Hi all,

    Some insight please...

    Our discharge was 8/15/05.

    We did not reaffirm a debt to Sam Ash Music, we surrendered the items. Our attorney said that they may or may not come and pick up the items. We have not heard anything from them relating to the surrending of these items.

    Is there a time limit as to when they should contact you? What if they do not contact you? Are the items now ours and we can do whatever with them?

    All my attorney stated was that, no, the items are not ours because we surrendered them, but we can continue to use them and that the music company may or may not come and get them.

    So, that is my question....how long is the waiting period?

    As far as I know, there is no set waiting period in regards to bankruptcy. I suppose your state's law regarding abandonment of property would apply. So you may need to look up your state's statute with regards to when personal property can be considered abandoned by the rightful owner (in this case the music store).

    The good news is, the music store is on notice of the bk and your intent to surrender, so I imagine the time frame is relatively short.
