I am new to this forum and I did not know where else to turn and was hoping some of you could assist me with an issue I am facing. To make a long story short, my husband and I filed Chapter 7 business and personal bankruptcy which was just closed on October 24th with a full discharge.
My issue is that during the proceedings our attorny explained to us and to our landlord whom we leased a building from for our store, that the merchandise that was in our store was to remain in the building until it was ither liquidated by a company that had a lien on the merchandise or when the case was closed and discharged.
The merchandise was never liquidated and I additionally called today and verified that the company that had the only lien on the property did not take it nor put it up for auction. Therefore the merchandise should have remained in the building until the 24th when our case closed.
Well my dilemna with this scenerio is that after doing some research on the building last week, I discoverd the landdord has put the building up for auction (which happens today at 2) and all of our merchandise, over $20,000 is gone....completely removed from the property. My question is if anyone else has ever dealt with a situation like ours? If so were you also informed the landlord had no rights to it and what did you do? We are trying to get a hold of our attorney to ask him to send a certified letter to the landlord to let us know where the merchandise is and when we can pick it up...but our concern is our dumb landlord may have tried to sell it and it was not his to sell. Do we take him to court? Ughhhh....it is so frustrating, just when we thought this year long process was coming to an end this happens...

Oh I forgot to mention, we have contacted the landlord at least 5 times by email to find out where the stuff is and also by phone several times with no response....
