    Ford really doesn't like ride-thrus.....

    As many have stated on here, Ford may have been "bankruptcy friendly" for those financing shortly after discharge, but they don't like ride-thrus at all. The last few months, Ford has been sending me "informational" statements after filing on 7/31/08. Sometime late October, my lawyer's office called and asked if I was going to reaffirm the car. I told them that even the paperwork they sent me told with the reaffirmation agreement stated that it was not in my best interest to sign it, so I was not going to. She told me that was fine and that they would have to contact the local lawyer that was representing Ford and harrassing them about the issue.

    Now, my payment is always due on the 10th of the month and as of today (11/4), I have not recieved a statement from Ford. Looks to me like they are probably going to repo it once my BK is over with. I planned on turning it in later anyhow, but it just kills me that they are so gung-ho to lose $6k-$7k when they repo this car and resell/auction it. I imagine that I'm not the only person FMC is doing this to this month so I can't begin to wonder how many thousands they are going to lose on repos.

    Oh, well. I'll be car payment free and my $1k beater will do just fine.

    I kept my Ford Credit car. Don't plan to reaffirm, but looks like I skirted by.

    I called the BK Ford lady, arranged for the surrendered car. Talked about my "keeping" car and said "I didn't get a bill!" She said nope... I said "I am pushing online payments, that OK". She said "Perfect".
    I asked about the bill and she said after the BK closed, they would start sending them again.

    She was actually nice

      I also have a Ford. Decided not to re-affirm and haven't heard a word from them in 2 weeks. My Oct payment was due and now Nov,not sure what's up

        If you are in an active Bankruptcy creditors are not allowed to bill you and you will not get any statements. It is your responsibility to make on time payments if you intend to keep your cars. You will have to call Ford and ask them where to send your payments and make sure they get them on time every month to avoid repossession.

        After I filed I never received another statement from Daimler Chrysler, even after I was discharged, and my online access was premanently removed. I had to make sure I sent them the payments every month until my car was paid off.

          As bad as the US car industry is at this time, why would they not take the money over a repo? After all anyone who buys used is not on the market to buy new. Makes no sense to me. 'Hub

            I was lucky with my credit union auto loan after I didn't reaffirm the loan. I had a payment coupon book for the duration of the loan. Two days before my payments were due I just walked the coupon and the cash payment into the credit union and paid it right there and then

              Are you planning on keeping the car.

              If so, you need to send them payments, they will more than likely stop sending you monthly statements.

                If you keep paying you will not hear from them. You are in the automatic stay so they can not talk to you. If you stop paying the will have a motions to lift the stay and repo the car.

                  Chase, Citi Finacial, and Ford have all been sending statements since I've filed. They say "Informational Purposes Only" at the top. However, this month, Ford stopped sending them.

                    We have a car loan through Ford and they also stopped sending us payments and terminated our website access. I've just been sending in the monthly payment with the account number on the check and we haven't heard anything from them since we filed in May, 07.

                      Decided not to re-affirm with Ford and got a "stipulation Agreement" and it states the they are going to pursue a deficiency judgement against me. I thought if I surrender ( don't re-affirm) they couldn't sue me for deficiency.

                      Would someone explain. My lawyer is on vacation and I have 20 days to discharge

                        Sounds almost like a debt-collector style threat. From what I understand, you shouldn't be able to be sued for the amount if it was discharged. However, I'd ask your lawyer about it.

                          You did not sign the stiuplation with Ford - right? On your original petition did you say you were going to reaffirm or surrender? If you said you were going to reaffirm at the time of the petition, but now have decided to surrender, your attorney needs to file a motion to surrender the vehicle. I believe you have 60 days (in a CH 7) after the 341 to surrender or reaffirm (according to my attorney).
