Guys i really need your help, I have been waiting for different opinion to make me understand things better
What can u say about this..
If you are married and filed taxes together, and earns about 7k take home. and has 4 houses and 3 cars. and owes about 2 million. how will i be able to get rid off my debts through BK.
The House I'm living at has a value of 450k (it use to be 950 but value went down, and no equity in it also) the other 3 houses doesnt have equity, except for one. I have not received any notice of default, except for 1 house.
I went to a lawyer, i gave all the information they want, but they dont seem to know how to help me, it seems to me that its very difficult for them to help me get away with my debts.
I just wanted to get rid of the 3 houses, and my credit cards. But i do want to keep the house im living at, and the cars. Im willing to make the payment on the cars, and willing to keep paying my (1) house.Its just i cant afford any longer to pay the other (3) houses, and my credit card is maxed out.
Should i wait till the bank take my house away? before i file Bk? How about the house im making payments then, will they come after that house?, i have no idea and i am getting tired of this creditors calling my house.
By the way, the 3 houses i bought, i rent it out, Renters cannot make payment anymore, so i have to absorb it, and my salary is enough to pay my the house im living at, and support my 3 kids and my partner, So tell me? any suggestion.?
Dang! i cant even afford to pay a lawyer its charging me 6500 where i will get that? thats why im thinking on doing it on my own and hire a lawyer to appear with me at the court, Or either way, But the lawyer has not said anything to me, in about 4 months. the lawyer cant come up with explanation about whats gonna happen.. she said its complicated and she will not be able to discharge those debts, so u mean im stucked? I also owed property tax,

Im from california, in debts of about 2 million, ( because of the 4 houses, and credit cards and cars) Dont hate! Im aware of what i did, and now im wanting to resolve it. I did took the means test and passed the chapter 7. Anyone out here can advise me , it will be greatly appreciated. I cant do CHapter 13. besides i have no way to pay it also if i do the 13.

You stated you took home around 7k. Did you use this number or your gross when completing the means test? How many members in your household? If you used gross and passed the means test, I don't see any problem with you filing Ch. 7. Go in for a free consult with a few different attorneys until you find one that does have answers for you.

Philslyn, I don't understand your post. I thought you worked with BK attorney's all day doing their paralegal work and preparing BK paperwork.

If the attorney you work for can not sort out your BK issue, then interview other BK attorney's. You may want to do that anyway, because a CH 7 at $6500 appears to be on the high side for fees.

First off, it is really hard to read your posts.

I would keep and stay in the house with equity. Get rid of the others.

I would kick out the unpaying renters.

I would do some pre-BK planning and study. You really need to study.

And you have to come to the realization that it may not be done in the way you want. You may have to sacrifice something. Just because it isn't what you want to do..... Or you think what you are willing to negotiate is good enough.

Yes U guys are right!

7k is after taxes already, that is for my pocket. Yes u guys have a point, why not keep the one with equity, over the one that does not have it, however i believe they will want me to sell it so i can pay them somehow,
Is my post very confusing? or its my English. Yes the lawyer charge 6500 that is a lot. And as for me working. Yes I am working at the law office, And i do Bk.
It's ridiculous that i have done Bk for clients, but cannot do my own thing.
I guess because theirs was very easy. mostly does not own any house, and dont have cars except for 1. and mostly credit cards debts. so its all easy.
I still dont know what to do. truthfully. But I dont claim to be smart, otherwise i wont be asking hhehee, i am in the process of all this Bk thing, and this is completely a whole new world for me. and this website has been so helpful big time. I have nolo book at this bankruptcy book that u get when u attend a seminar. Honestly there is a lady who does the Bk at work, and she seems so mean all together, she wants me to learn everything by myself, she dont answer question, shes mean as i said. SO i found this website and other sites to help me.thanks guys
