    Chapter 7 Discharge vs. 13?

    As of this past Sat. mine and my husband's 60 days is up. Needless to say I'm anxious to get the discharge and start rebuilding.

    I was telling my father about our 60 days being up, and he said that it took two months for him to get his discharge papers. The difference is, he filed for chapter 13. It took them two months to send him his discharge papers after he made his last payment.

    Will it take us that long to get the discharge papers because the system is bogged down (with all the new filings) or did it just take him that long because he went 13 and not 7?

    I'm not really sure how a Ch 7 discharge goes, but when my cousin made her last payment in her Ch 13, it took about 2 months to get her discharge papers. She had said the trustee's office has to go over everything in the case with a fine tooth comb, as far as, making sure all the creditors were paid their proper amounts, etc.

    It is possible though, that with all the new filings, it could be taking longer.

      Chapter 7 is different. As long as you are a no asset your discharge should happen as scheduled. In our district the order is automatic, computer generated, sent out in the mail the same day. If you have access to PACER you can print it as soon as it is issued.

        I suspected that the two months was because he went 13, which is more complicated. However, he kept arguing with me. Gotta' love him anyway.

        Though, like you said, it wouldn't surprise me if it did take them a bit longer than before because of all the new filings.

        Yes, we are a no asset case. So, depending on our district, we could get the papers as early as this week?

        No, I don't have access to PACER. I decided early on in the process that PACER wasn't for me. I would have obsessed over every little entry and probably made myself sick over it too.

        I'm one of those people who doesn't even do well with package tracking (UPS/USPS). LOL! "Where's my stuff?" "Where's my stuff!!!" "WHERE IS MY STUFF!!!!????" I would have drove myself mad looking at PACER multiple times a day.

          Our last day for objections was yesterday. So far no discharge yet. I'm checking Pacer daily.
          8/5/08 - Filed Chapter 7
          9/10/08 - 341 Meeting - It went great
          11/10/08 - Last day for Objections
          11/12/08 - Discharged & Closed!
