    advice please

    I am currently struggling 2 months behind on some CC. How long before they start garnishments?

    I am getting ready to file, can I buy some Christmas presents with the remaining credit I have?

    You must be kidding...

    This is a bankruptcy forum. No one is going to advise that you go out and actually use your credit cards - especially if you already are behind in payments. The best thing you can do is have a simple Christmas, without monetary gifts...in fact, there is a recent thread around here somewhere about celebrating without spending money.

        As to #1 - Before creditors/collection goons can do anything as drastic as garnishing your pay or freezing your bank account they have to sue you first and get a judgment.
        As to #2 - When do you plan to file?

                  Good grief, quit acting like your "stuff" don't stink, if you KWIM. We're ALL here for the same reason. WE HAVE DEBT THAT WE CAN'T PAY. Get down off the pedestal.

                  As for the OP, I charged tires, of all things, 2 weeks before filing and I didn't have any problems.

                  BUT, I also was current with my payments when I filed bankruptcy, believe it or not.

                  I think if you're already behind, I definitely wouldn't charge anything more.

                    I'm new here and would like to start a thread but can't seem to find a place to go to for that.

                    I wouldn't charge anything on your charges. Cut them up and just use cash if you have to buy gifts. IMHO LinKid

                      I would strongly advise you to forget that you have the cards if you plan on filing shortly, its hard, I know, but you are not the only one in this position at this time in our history.

                          Bean50 if you are allready behind and know your in trouble,then cut those credit cards up right now and concentrate on living on cash.You could explain to family and freinds that you just cant afford to buy gifts this year as you would like.And if its your children your worried about,its good that they understand the reality of your situation.Bankruptcy is a big step and we need to use it the way it was meant...a second chance...Please dont keep charging knowing full well your going to discharge it.While you CAN do it and get by with it ,its just not right....just my opinion.

                            OMG - another "morals" preacher. AIG, banks, etc. are all getting bailed out by the govt. Filing bankruptcy is bailing yourself out.
