    when should you know if

    A chapter 7 will be told it is going to be a 13? we are under median for a household of 4 and 5 (filed 5) 2 older dependents in college, lawyer thought it may or may not fly, and for a family of 3 we show 17k over median, I keep waiting every day to get a letter in the mail from the trustee saying they want more paperwork or they will not accept the HH size, but my question is can they do that at the 341 or after? or will I know before?

    Wow, doesn't seem fair. Living expenses for kids away at college still take a good chunk of money.

      well actually

      One was aaway but now she is back home living full time and attenting full time in state, so we pay for everything, the other is in the next state so she is home every weekend and end of term.....

          In all probability if the trustee (or the UST) has an issue with the filing you'll know before or at the 341.

            I know how you feel its definitely not fair. Our lawyer also did not let my parents count me as a dependent because I am in college-and they also pay for most my school expenses also . He said the trustee does not have to be that "understanding" since over 18 is supposed to be considered an adult.

            supposedly we should be able to pay for college ourselves according to the law, since you know teenagers have money to fully support themselves right after high school. pretty ridiculous

              do you live at home or work? I know a lot of people that have been able to include them... under 24 you should be able to as they are my legal dependents with the IRS so I am keeping my fingers crossed.

                For federal student loans in college, they make you include your parents income until you're 24, whether you live by yourself or not (at least they did when I was in college) so it should work the other way too. There are exceptions but I think you have to be married, have a kid or be a ward of the court. I don't see why they wouldn't be considered dependents.

                  I've been living at home because of the bk this semester and don't have a job right now-I am a dependent student also and don't get any fin aid bec of their income. but yeah our lawyer said that including me would just be too "complicated" and he didn't want to include me because he felt it wasn't needed. But I'm sure there is a way to include them its just that our lawyer didn't want to go through the extra fuss or something so I don't think u should have a prob!
