    A FEW QUESTIONS....Boy this is scary.

    Ok...thinking of filing but have a few questions. I cannot get my credit score up no matter how hard I try. I can't get anything refinanced because of it. I feel like things could'nt be any worse than they are so just wipe the slate clean and start over. I have a lot of good credit. house pmts, car pmts, personal loans ect. But there are things lurking in there that just keeps it down. One question i have is. Once you file...will the good credit you have (things you've paid off, loans you are reaffirming, ect) remain on your report and help with your credit score if all the negative is wiped off?? I'm new to this forgive me if any of these are stupid questions. I have some things that are on my credit report...such as an overpayment to social security that will not let me refinance my home ect. will this be discharged? also my husband has a judgement against him that he just found out about...what about that? I am getting nowhere with my current situation and feel like the only way I will ever be able to get anything financed again is to file and get them off ...cause I sure can't get anything now and won't until we get these things off our credit report. another question. debating if I am going to keep my home or not. Not a lot of equity in it, needs some repairs. but I consolidated a while back and my car is in the consolidation. I do not want to lose my car. Anyone know if I let the house go will that mean the car goes too? Im thinking yeah but wish there was some way to keep it. also how long when you file and give your house up in the BK will you be able to remain in the home? also I am a month behind on my house payment..will that have any bearing on any of this? lastly, me and my husband just bought some land that we plan on putting a mobile home on. the land is owner financed...can they take that or can we keep it? I know these are a lot of questions and im sorry...just really trying to figure out things...any input would be appreciated. Thanks in advance... ts

    Hi, I know its a very scary time. We all go thru it. But you get thru it, thats the good thing.

    As far as your credit score, it will drop. Even though you ar keeping up with some payments will will drop low, but then after discharge it will start to creep up again.

    Also, about keeping the car. Yes, you can. It doesn't matter that you used some of the money to pay off the car. Is the car paid in full now?

    Keeping your land, I guess it depends on your states exemptions. If you are giving up your house and going to live on the land in a mobie home, then i would think that they would not take that. But then i am not an expert.

    Have you talked to a attorney yet? You should go an talk to atleast 3-4 that have fee consultations, so that you know what you can and can't do.

    Keep reasing and reading on this website, it has a wealth of information and ask as many questions as you have. None are ever stupid....

      thanks for your reply. I just don't see how my credit score can be any lower than it is already which like I said is a main reason I'm doing this. Good to know though that it will get better. The car is not paid off...it was attached to my mortgate when I consolidated everything. the bank has the title to it. thats why im confused if I let the house go back to the bank if they will keep possession of the car too. again thanks for your reponse. ts

        Well i can tll you that I took a 2nd mortgage on my house and I paid my lease up for 15 months, now I am bking on the 2nd mortgage and I am keeping my car. I still owe money on my car. I hope that helps.

        Please go and talk to an attorney it will atleast let you know where you stand and maybe ease some of the scared feelings you have.
