    Filed yesterday... Seemed too easy

    Hey everyone. I've come here a few times and read through a few threads. My husband lost his job in May. Our house has been on the market since Feb with no offers and we have been living off of my salary and credit cards since June. Up until last week, we were looking into foreclosure but decided to get a free consultation with a lawyer and I am so glad we did! We met with him last week and based on our situation, he felt that a Ch. 7 bankruptcy would be our best option. We have a 357K mortgage that we were paying $2700/mo on that we are surrendering and about 6 credit cards totalling about 20K. We have 2 cars, one lease, one financed that we are keeping.

    I can't believe how easy the whole process was! Our consultation lasted less than an hour last week. We did the online credit counseling, gathered all the needed information and met with him yesterday to have everything entered into the system and filed. That took about an hour and a half. We haven't received the date for our 341 meeting but they approximated it to be around Jan 7 and approximately 45 days after that we will be discharged!

    We are so relieved with our decision already. To think that all we are responsible for now is every day living expenses and two cars is unbelievable. A personal friend has a house for us to rent in January and is going to allow us to personalize it into our "home" for only $900 a month!

    I am still in shock as to how easy this whole process is/was. Our attorney even told us that filing bankruptcy is becoming a trend in some areas of the country. I look forward to posting here and will continue to update our status.

      Congratulations! Sometimes taking that first step and deciding BK is the only option, is the hardest step.

        Congrats. Definitely the events leading up to BK are far more stressful than the BK itself for a lot of us.

        And it only gets better.

          BK is a trend? Wow I never thought I'd read that one lol....Sure is sad that so many folks are having to do it, but having an attorney call it a trend? To me a trend is fancy boots or short skirts..just sad thats all...wish I didnt have to do a trend..
          So it was easy for you? Boy Im sure dreading doing all the paper work.. Altho I have no idea how much paperwork is involved. Maybe my head is making it worst than reality.
          How much paper work did everyone have to do anyway? Was it hard? I would think pricey all your possession would be the worst..

            I agree with epiphany...the event leading to the bankruptcy are so much more stressful than the actually bankruptcy itself. Our bankruptcy was very easy. I kept waiting for the other shoe to drop, but thankfully it was very very easy. I attribute that to us disclosing everything and having nothing to hide.

            I hope all goes well with your case.

            9/10/08 - 341 Meeting - It went great
            11/10/08 - Last day for Objections
            11/12/08 - Discharged & Closed!

              I have to agree that after months of worrying and wondering, filing was actually MUCH easier than deciding to file.

              My 341 is on Tuesday and I will be glad to get it over with. Discharge will be January 26th if no objections. So far no creditors have replied in terms of showing up, etc. No one has filed a claim, either.

              I am looking forward to my fresh start.

                Congrats!! We hope to file in a month. I must agree with the others that the events leading up to it are very stressful. We've never felt so broke in all our lives!! I have all of our paperwork ready to go (except the most recent bank statements, pay stubs, etc). Getting that together seemed to be easy. This week though, by far has been the worst. We were unable to make our house payment this month and that sucks. We want to keep the house, but if the money isn't coming in, it just isn't there to give. My DH is in car sales. Sold only 3 this month - last year at this time, he sold 20 for the month of November. THEN, to top it all off, his ex has retained an attorney for some unpaid medical bills for their daughter. She knows what we are going through, but is still being a #%%##. We just told her to get in line with the rest of the debt collectors!!

                Again, congrats on your filing. You are on your way to some relief!!
