I have 2 questions which are a part of my husbands bankruptcy (we filed seperately).
1st- He filed in May 2008 and was Discharged October 9, 2008. We did not think to put our cell phone provider down on the list, but from what I read all of his debts are discharged (listed or not) because it was a no asset case. He has a $900 bill with the cell company which he did make payments to all along, just not enough to get the balance to 0, and some of it was from before May and it just keeps rolling over. I have read that after discharge he gets like 60 days or something to let any contract that he has know about it and that he can cancel his service. Is that right? And how does this work? I called the company and they said that they would look at all of the payments he made during his bankruptcy and apply them to the charged that occured during the bankruptcy and let us know what/if anything is still owed. But I thought that if he canceled his contract that would be included in the bankruptcy and he wouldn't owe them anything...
2nd- He has a car that he wanted reaffirm and then changed his mind. He never signed the reaffirmation agreement. The car company sent him 2 surrender letters, one dated before the discharge and once dated 2 weeks after discharge. He never signed those either because we assumed that since the debt was discharged they would just come pick up the car anyway. Well... they still haven't come to pick it up and we're going on 2 months. How long does it take for them to come get it? I tried to call them several times but they keep putting me through to someone's voicemail who doesn't ever call back. After a certain amount of time is the car considered abandoned? It's a nice car, I can't imagine they would just leave it here, but then again he owed a lot more than it's worth.
I thought after discharge this would all be over and done with... Thanks.
