Why would creditor appear at 341?

    If a person waits say 6 months it is I believe where they gotta write it off the books I have read here before? Why noy just wait tiil after then when they have sold it to file?Or maybe Im missing something.I am hoping by time I file the amounts will no longer be with oc where theyd appear at 341

      They can't force you to reaffirm. And even if you choose to sign one, you can rescind it - I forget what the time limit is on that, but it is allowed.

        I was paying on the account I just hadn't used it in a while. So I did make payments up until about 2 months ago.

        I couldn't have held off on filing because this was just one of many creditors I owed and I wanted to tackle this problem as soon as possible. The phone calls from all of them were relentless and there is a rental home involved in my Chapter 7 so I didn't want it to foreclose without being included in the BK.

          Tell them "NO"...Under no circumstances should you sign a reaffirmation agreement with a computer being collateral. The attorney is coming to intimidate you into signing one. It is the only strategy they have. Just stand firm. You can do it. If not, that's what your paying your attorney for. You'll be fine.

          10/20/08 - 341 Meeting
          12/19/08 - Last Day for Creditor Objections
          1/5/09 - Discharge Order; 1/13/09 Case Closed!!!
