    Dead cars?

    I've gotten myself in a lovely hole here.. I've had papers served on one of my old debts that is with a less than delightful collection agrency... Pretty much with my income and expenses at the moment chapter 7 is going to be the route I take... Probably will be filing Pro Se as I cannot affort an attorney...

    Anyhow I have 4 cars that are titles in my name but haven't seen the road in quite some time except one that just died last month and got replaced with another $500 gem.... I planned lising them in my assets and valuing them at the price they would be worth as scrap.. Some have had parts removed over the years, they are all rather rusty and not road worthy... I wasn;t too worried about exempting any of them (although the spare parts are handy).. Does this sound like the right way to go with this>???

    I would sell the vehicles for scrap value with some nice photos of them being loaded on the junk man's truck, then use that money to pay a lawyer to file the bankruptcy. I considered filing pro se myself and then determined that if I did a lot of the preliminary work, I could find a lawyer that would charge me a reasonable fee.

    I know there are people who successfully file on their own but you are already questioning yourself. What will happen if someone shows up at your 341 to object?

      That was the plan till the bottom fell out on the price of scap steel.. There's not in a real accessable location so it's been hard to even give the things to the junk man....

      I decided a few days ago I'm going to need a lawyer.. I've got questions and alot of goofey things to deal with.. Been working on finding one that will work with me as you had mentioned... The first thie that are very close by want $30 or so just for the darn consult.. Back to the yellow pages...

      I've got the pre filing course under my belt, and some of the basic paperwork done.. Still have some income and asset things to deal with... I found I may be elegible for legal aid to assist... Not sure if I want to go that route....

          And, you should be able to get free consultations. Anyone charging for that is not worth the time.

            Thanks for the heads up on Legal assistance Greenink...
            I've been back and foruth with them but not sure if I am elegable yet... I've done about 3 free consults over the phone today and have been quoted prices around $1500 for the job... Plus court and counseling fees...Basically it'll be a no asset case except for some junk cars I need to be rid of somehow... Does that sound in line?

            I've asked around about he guy charging for the consult and have heard good things. I talked with him on the phone and gave him the details and was fairly impressed myself...He's pretty reasonably priced.. Since I do have a good bit of work already done he'd be willing to work with me on that... The 30 bucks is for the consult at his office, basically sounds like he'll be beginning to get the paperwork together....

            I guess I'll wait and see if I get anywhere with legal assistance before I take the next step... I'm not getting sued till the 18th so I got a little time....

              When you say you are not getting sued until the 18th, does that mean that is the court date or the response date on your summons?

              You will definately want to bring a copy of the suit to your attorney so he can include it in the filing.

              You can delay the suit a little (sometimes a lot) just by responding to the summons (proper response) while you are on a search for a good attorney. This will also give you time to sell the cars/vehicles etc. Don't let a creditor force you into BK prematurely.

                Thankyou craigslist I found someone to buy all the cars for $100 a shot.. Actually a little better than scap price.. Spoke with DOT today and all I have to do is write junk actoss the title and I'm clear of them.. As he hauls them out over the next few days I think I'm goind to take alot of pics of them just so I have some documentation on why I ditched them all so cheap...
