question 341 wed, reagrding house

My 341 is wed at 8.45 am very nervous My mortgage is due 17th Dec, we have filed Chapter 7 under median for family of 5 even under for family of 4. If the trustee decides not to accept us a family of 5(long story) and make it a family of 3 to try to push us to a 13 we are 15k over a family of 3.. we would then need the mortgage payment for the means test, we filed Oct 31 and are current on the mortgage.. it will be a week after the 341 we wont pay, we have just decided the last few days to let the house go if we cannot work a deal with the mortgage company, will they notify the courts we are late? also if they change it to a family of 3, can we catch up with the mortgage payments and decide to stay so we can use it as part of a means test?
or would I know already if household was not accepted....?

Well B65, as convoluted as I am reading this [could be me and three Merlots], I would not “pre-worry”. Without more explanation of “your long story”, I would go there with what you have and act as normal as you can. In fact, I would suggest you go to some other 341’s and sit in on them to see just how simple they really are.

Seems like it is a common flaw for everyone to be too worried. Please consider that as an educational as well as an inspiration building lesson, well worth your time. ‘Hub
