    Won two trips this past year valued both

    total about $10,000 and I will be getting a 1099 form for both in 2009 to file with as income. I am probably under a hair to pass the means test in NY for a single person..will the wins put me over and be counted as income towards the means test?

    Filed chap 7 in Spring of 2001

    I know I can qualify to file again for Chapt 7 in 2009 but when can I file again? On the anniversary of my file or discharge date in 2001 or does it roll over as of January 1?

      I believe it is the discharge date. When were the trips received? Was it within the six months prior to your anticipated filing date? If no, then they will not count as income. They may not anyway because you didn't receive money for them.

        Not income right? is an asset...

        Means test is about your income and "owning" these items you describe is an asset. You might lose them if you file to pay your creditors but there would be no place to put thse on the means test form.

          Have you already taken the trips or will you have taken them prior to filing? If you have, than they are no longer an asset.

            I already took the trips- one last January and the other in November.

            Don't how they would claim an asset because it's not something I can sell to satisfy a debt because there is no prize transfers according to the rules of the contest. If I don't accept the trip win as is, they pick another name.

              Then you have nothing to worry about. They are not income and they are not an asset. The trips don't even need to be mentioned. There isn't even a place on the Statement of Financial Affairs to place the trips.
