    options for auto

    Hello all-
I have about 7-weeks until discharge.
I have reaffirmed a car. But since I was current on payments, I did not need to do any paperwork to reaffirm the vehicle. I am significantly upside down in this car -- owing about $7000 more than the car is worth.
After discharge, could I just stop making payments on the car and elect to have the company take the car back? What would be the recourse of that on my credit (considered a repo?) Any other ideas? Thanks!

You have kept paying on it so far, but listd it as a secured creditor in your BK did not sign anything reaffirming it officially? If that is the case, then the BK should discharge the debt, meaning they couldn't come after you for the balance.

Someone else here can confirm, but I *think* even if you stop paying for it now, they can't take it until after your discharge without going thru the court to request the stay be lifted.
Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
