    is this true?

    "What you have to worry about is the 10 days from your 341. If no presumption is filed in that time you are pretty much home free in regards to the UST.

    If the presumption is filed you have 30 days from presumption for one of a few things to happen. THe UST can push for you to convert to a chap 13, decline to pursue the matter, or your case is dismissed. "

    My 341 was on the 10th Dec so by say the 20th Dec is when the UST can file to convert to a chapter 13 or dismiss?

    do they have to stick to the 10 day rule by law or can it be day 12 or 14 etc?

    also if it is quiet and nothing after the 10 days what else can he file for the 60 days than abuse?

          Usually the UST only gets involved if they suspect abuse. There is not a set 10 days, they can file a presumption of abuse at anytime prior to discharge. You shouldn't worry about this if you can back up everything on your means test.
