    341 meeting 12/16, commence with the panic

    My meeting is Tuesday afternoon and I am starting to worry. My bankstatement that was filed shows a very high balance due to get my student refund check (which has since been elimiated, i have $4 in the bank right now). I'm worried they will look at that and start asking questions, or start asking how I got in this situation (gambling addiction). What if citifinancial shows up to start trouble? What about my account with my furniture, if they try to take it from me I won't have a bed to sleep in. Mine is a no asset case. I'm worried about when to file my 2008 taxes next year, cause my discharge date isn't until Feburary (I always file early).

    The sky tends to always be falling for me, when I think things are going smooth, I always run into a bump in the road...no matter what the situation. So, I'm worried. Sick.

    I wish this were over already.

    Hey, I'm sure this seems super intense, but I think you are over thinking it. First, you can show, I'm sure, where the money from your student loan came from, how it was spent, and how much you have now. No worries. Hopefully, your addiction is in the past. It really makes no difference as to WHY you have the debt, as long as it doesn't constitute fraud. No worry there. As far as creditors showing up to hassel you, they won't, unless it's uber obvious that you borrowed the money with no intention of paying it back. So relax. What's done is done and I'm pulling for ya!

      Hi, relax and take a deep breath. They are not going to take your bed away from you. I had alot of money in my account to when i filed because my mortgage payment didn't come out. They didn't say anything. As far as citi showing up, most of time they never show up. I had 40K in citi and they didn't show up. As far as the income tax, don't file until after your discharged. You will know anyway, if the trustee is going to have an interest in the income tax they will probably say something at the 341. Is it alot of money that they would have an interest in it. They never questioned our 2008 tax return. You are lettering you nerves get the best of you. Do you have an attorney?

        yes, i have an attorney, which reminds me i better call the office and make sure they don't want me to bring any additional paperwork. i don't know if they can get me for fraud. the cash advances i got on the credit cards were crazy amounts, but i did try to pay the bills for a while, until i started owing more than $500 a month on all the cards at just the minimum payments, before i couldn't pay anything at all anymore. i'm just worried. i need a beer and a bed. my returns used to yield up to $2000, because i was claiming my "sister" (long story involving adoption of a cousin) while she was in college, but since she didn't go this year and moved out i won't be claiming her anymore. i would hate to file later than sooner though...lol..i need the money!

            good luckk tomm! if it helps any we had our 341 last week and the trustee didn't show any interest in future tax refunds at all we watched meetings for 3 hours- unless people had assets they had at the time and were trying to hide, which doesn't seem like you do it goes fast. and as for creditors showing up no one had a creditor show up except for one lady who had a 700k loan so yah-and our lawyer said that those creditors who show up don't get very far in this game because its just to much of a hassle. The trustee was actually mean towards the lawyer/creditor who showed up. but yah I think you will be fineee just go early and watch a few cases that will settle your nerves!

              Nullbalance: It is my experience to see that everyone has fear of the 341 except us. We were so clueless we had no idea of what was going on, until this forum.

              As I see it, your gambling addiction MUST BE worked on and overcome. You WILL get your new start but it will go for naught if you still have your addiction. PLEASE don't disappoint yourself and others as you have your chance now. 'Hub

                Nullbalance, you are going to be fine. Just make sure you have your DL and SS card with you. Dress conservatively--dress casual as though going to a nice restaurant is good. Leave any jewelry at home.

                Leave plenty early so that you don't get caught in traffic and be late. Getting there ahead of your appointment will let you watch other 341s ahead of you. By and large, it will be the same standard questions.
