I have an Attorney and we are about to file any day now. I have been sort of lucky up till now, all of my business lines of credit have threatened court but since I have a lawyer now they have all backed off. I know if you are close to a judgment that you should try to stop it but what about a charge off? I got a letter from Wells Fargo today saying this was there last notice before charge off....does it matter? Should I try to stop it or does it even affect anything?

"Charge-off" is an accounting term. Nothing else. Once this debt is discharged in bankruptcy, the account should indicate "Included in bankruptcy". Some creditors might pull a fast on you and leave the "charge-off" comment on your credit report IN addition to the bankruptcy comment. That is when you start disputing the wrong comment with the CRAs.
