We decided to give up our house today. We owe like 80k and it is worth 50k. It needs so much work and obviously have no $ to do so. Our lawyer told us not to worry about moving, she has clients that have been in their house for 3 years now with no payments and no sign of them kicking them out. We are just scared to death! So my question, how long until you had to get out of a house you surrendered? Thanks

We filed in August and are in MI. We have not made a house payment since july and are still in the house. The process here is thath the mortgage company has to go through the foreclosure process. I think they are backed up a bit. We are suppossed to get a notice of the upcoming Sherriffs sale and will have 6 months from then before eviction. So far no notice...
We are riding it out and saving for a deposit and a few months rent so we can get a place when the time comes.

It depends on the state you live in. My house before i moved was in PA a Judicial state that is a minimum of 265 days for the process. I did sell the house before forclosure but the mortgage CO had asked me to stay in the house until they asked me to leave. You have time and shouls have lots of warning. enjoy liveing rent free for a while

I stopped paying in Oct and my lawyer told me it could take up to a year before I have to leave. I am in Northern California. I just wish I wasn't unemployed for I'd be able to save lots more money but can't save much while on unemployment.
