    oh boy. another tax question, sorry!

    i feel like i'm gunking up the forum with my questions, so my apologies in advance.

    i think i received a bit of misinformation. rather, i didn't do my research well enough. in my last thread i said i couldn't find a way to exempt my tax refund? well, it turns out in idaho the EIC (earned income credit) is considered public assistance.

    approximately 75% of my refund this tax year will be EIC.

    so i SHOULD be able to exempt at least that amount, correct? now here's my question -- i don't know exactly what my refund amount will be, nor can i find any resources to calculate the amount of EIC i'm entitled to. if i were to amend my schedules to include this exemption, do i need to wait till AFTER i file my taxes and receive an exact amount? or should i put an estimated amount? can i even exempt an ANTICIPATED EIC or must i wait until i've filed my taxes?

    i know i sound so clueless but i'm determined to make this pro-se filing a success and not lose more than i have to in the process. any help would be SO appreciated.

    EDIT: i filed ch7 pro-se on 12/22 in idaho. little bit of info i left out. ;)

    You need to amend your petition BEFORE discharge. Simply describe what you are exempting, but list the amount as unknown.

        a few more things... i'm going to amend to add this exemption, however, do i also need to amend my summary of schedules included with my original petition? i don't have a dollar amount to modify on said form since the amount of my EIC is yet unknown, so i assume not?

        also, would it be wise to do this before my 341 meeting? i've read that many people were asked to amend things at this meeting and did so afterward, but would this mean a rescheduled 341? further, would it make me look dishonest to wait so long to file the amendment?

        should i just do it now?

        phew. for a seemingly simple bankruptcy there sure is a lot of work involved.
