    First time poster with Quick questions

    Long time lurker, first time poster. I have finally reached the bottom. I have about $20,000 in cc debt and owe $10,000 to Honda for a repo. The car was worth 17k but they sold it for 7k. I have no assets besides a 1200 truck with a blown motor my mother just had to pay to replace. I have no job but will be back at work shortly, hopefully. Most jobs I qualify for and interview for are 12/hour. Comes out to roughly 25k a year.

    I would pass the means test for chapter 7 for being below median income in NJ and also by calculating disposable income per legal consumer. My question is I live in a apt with my Mother and Brother. Brother makes decent money (13/hour) Mother is fully disabled from having 8 strokes, epilepsy and aerotic valve replacement she receives ssi or ssd (not sure of which) even with there income factored in I am still under median income and pass disposable income test.

    My question is how would I file? Would I have to include them? Or would I do this by myself? I am going to file with an attorney within 2-3 Months. Just dont know if I have to bring them into this mess with me. Im tired of robbing peter to pay paul and having my mother pay my minimums for me, I feel less then scum.

    I understand the 341 and the whole process. Do I have anything to worry about if I am under the Median and disposable income with me solely and with family included? I look back and 2 years ago I was on top of the world and now I am living like a bum. Only positive is this is the best education I have ever received in my life. I will truly enjoy the small things in life and not live in debt to keep up with Jones' I will never be in debt again, no c.c. no car payments, nothing. Mother always taught me to stay away from credit cards because there evil, and I wish I listened. This stress has actually brought me to my knees and made me cry for the first time I can remember. Just makes me feel like I am not a man, should be supporting her, not the other way around.

    BTW I am glad I stumbled upon this site. Vast amount of info and you guys are very nice and kind with your help. I truly appreciate this help. Thank you all in advance!

    Glad you decided to stop lurking and join us
    As far as getting your family involved you will need to get income information from them. They will not be on your BK at all. You will document your portion of the living expenses

      yeah we just have a agreement that i pay all teh rent $1030 which I usually give her in cash and mom and bro cover, elect, cable, phone. Does it seem like I have a chance? I am almost out of what little savings I had. Just hoping for my second chance in life. I mean with almost 22k in debt and making 12 an hour i could never get out of this. are there any other deductions i can put on the disposable income besides elec, cell, rent and car? such as gas etc

          honestly you dont know how much that means to me, I am just worried trustee will give me a big problem and I dont know why. I just expect the worst with everything. I mean we dont make a lot of money and when I seen the medican Income I wish we made that much. Do you think I will have any prob with a 7 or will they try and push me into a 13?

            You can't be pushed into a 13 if you don't have disposable income to fund a repayment plan. If you are under the median I would anticipate smooth sailing.
