    Am I responsible for this??

    Hi everyone. Today I get in the mail a letter from the bank that I had my boat loan with. We gave up the boat in the BK. They came and got the boat but never contacted me. I went outside and told them that I have a stay of order. The guy says well the bank told us it was discharged and gave us a letter that said demand unit. Anyway, its gone now and we received this letter today saying that they are going to sell the bot and that if the amount that it sells for doesn't make up for the amount of the loan, that I am going to have to pay the difference. Is this true??

    If you did not reaffirm the loan and gave it up in BK then you are not responsible for it anymore. If they auction it off and receive less than the loan amount then you are not responsible for that amount.

      Why would they send that out? Isn't it illegal on there part to send this kind of letter? Furthermore, they took the boat illegally too. I am not discharged and they came and took the boat anyway, now they are demanding money if they do not sell it for what my loan amount was.

        If you filed with a lawyer, contact them and let them have the letter. They will take care of it.

          Nope you are not responsible for the deficiency enjoy your fresh start. Or since you are not discharged call the bank and tell them to bring it back until you are.
