checking account question

    checking account question

    I have an old checking account I ow 464.00 to. I had to use my overdraft when things were tight so I used some of it and still have not been able to pay it back. It is now with Chexsystems(sp.)

    Should I discharge it or pay it back before I file so that I can open another checking account after bk?

    Make sure that the Check system will take you off. Once on, I understand it is tough to get off. 'Hub

      they will take you off of chexsystems if you pay the amount owed. It is *not* automatic if you pay it with the bank, and it is not fast! It usually takes 4-8 weeks to get cleared. You'll have to send them the proof that you've paid the bank

        I just did not know if I should include it in the bk or if it really mattered either way.

          And if you don't pay the bank and show proof of payment, you are on the system for 5 years. That is a long term penalty.

          There are banks that do not use chexsystems, but it is rare. Most of the major banks use that report to open your account.

            So you cannot discharge a bad debt to a bank in bankruptcy?

                  U know that if you owe a bank not a credit a card. its more likely will be difficult for you to open a new one. bank account is an asset as a personal property. they are not your creditor. if it was me i would pay it.

                    yea I was thinking of paying it as I can. Who knows what the fees are by now. If I paid it before filing would it look like preferential payment since I chose to pay them and not my creditors I am discharging?

                      i dont think so! but if u like after u got discharge, you can pay them people. or wait till that bank creates a problem and if they did then you pay it.
