    I'm midway through my 60 day waiting period. Trustee filed a "no asset" report, which is good. On NYEve, I received a summons for foreclosure. I had hoped to avoid that, by giving my lender a deed in lieu of foreclosure in exchange for leaving the home early. But, they declined to accept that, so screw 'em - I'll stay in the house rent free until I am forced out. It makes no sense to me that they would incur the expense of a foreclosure action, but that's their prerogative, I supppose.

    I am anxious about my tax return. I hope that, having filed a no asset report, my bk will discharge and then close promptly. After the case is closed, am I safe in assuming that I can file my taxes & then keep the return?

    This waiting stinks. The first 30 days went by fairly quickly (the distraction of the holidays helped). I know there are others on about the same timeline as me - how y'all doing?

    Well i got 25 down and 35 to go. Yes the Holidays distracted me as well. Now im ready to get this behind and move on.

    I am all so a Non-asset so im hoping i wont have to give the trustee my tax return as well. January is going to be the Longest Month but once i get threw it im thinking i should be discharged on the Febuary 6th.

    Yep this Waiting Sucks but will be worth it to get this heavy load off me for good. It feels good to buy something now with Cash and not worry about paying for it later im kinda like'n this.

      Yep I'm on the Jan list for a discharge also. This is going really slow can't wait to be done and move on and also hope to get tax refund.

        Oddly, my attorney just advised me to file my taxes right away. I will do so, and get a biggish return. Attorney said not to worry about it, that I have enough exemptions to keep the amount I expect to receive. So, I guess I'll do as he advises. Odd, though - I would have thought it was safer to wait until after bk discharges and closes to file. Perhaps it seems more honest this way?

          I remember one client that i filed for, i believe it was oct 2008 close to Nov. and she was worried about her return. i told her to not worry about it , i told her she will be discharge anyway before the last filing of taxes. as well as my attorney say so. hope id share that with you

              We are about 24 days in as well. Trustee indicated we would be an asset case because he mentioned having to get a car and trailer appraised. Our lawyer said it would be around 3 weeks before we knew anything and the waiting is so hard. I am so stressed out about so many things right now and I absolutely HATE not knowing what will happen. I'm one of those that has to have a list of things and a plan and have everything mapped out lol. I really don't care if he does take the vehicles, we can replace them with the exemption money, I just need to know if he is or not.

              Strangely enough I'm too chicken to get on pacer and look, which makes no sense lol. Anyway, I guess no news is good news in my case. Best case scenario we are no asset and get to close right after discharge.

              Our housing situation is stressful for me too. We have surrendered the house we built 4 years ago. We have decided to relocate and have the opportunity to have rent at a super low rate but have to rehab the house and relocate about 2.5 hours from where we now live. Hubby is self employed and my income has fluctuated wildly lately. We are barely buying food let alone have the money for floor coverings and a new toilet etc. for this house. gut rehab. It is our best option in the long run because hubby has work there, its just getting there and not knowing how to get there that has me super duper stressed. I wish I knew when I have to be out of this house and what to do with all the stuff I have to get rid of or store in order to get into the tiny little house we're going to move into.
