    Employer Notification

    There was a writ of garnishment sent to my job.My attorney just filed my case and told me that notification will be sent to my employer not to start garnishing my wages.Will my job be notified not to process the garnishment because of bankruptcy or it wont give a particular reason why not to process the order of garnishment.

    I think your lawyer's letter will be ignored by your employer. The only thing that will actually stop/never start a garnishment is another court order rescinding the original garnishment order.

      I'm an employer and can tell you that magyar123 is exactly right. A letter from an attorney has no authority over a court order to garnish.

            No - the bankruptcy trustee/court does not have anything to do with the court that sentenced you to the garnishment. You will have to go to that court yourself to vacate that judgment. Once that court sees the paperwork that you filed bankruptcy they will then reverse the original order/sentence of garnishment. Remember the bankruptcy court/trustee is federal, the one that sentenced you is state/county. They have absolutely nothing to do with each other.
