reaffirmation question

    reaffirmation question

    we are 25 days in our 60 days. we only got sent one lot of reaffirmation papers on our car, we decided not to reaffirm. The lawyer does not recommend either. trouble is on the papers you have to check reaffirm or surrender. Do I just leave it and fill nothing in? I do not want to surrender I want to pay early each month and hope to keep it.. I have never missed a payment. I am worried the lawyer will tell me I have to check one box and if I have to put surrender then that looks like I have more money available. Just do not want to rock the boat with only 35 days left to discharge.

    do you have to reaffirm by law? If not you can check reaffirm and jsut not do it. You have to right to change your mind

      Technically speaking you have to choose reaffirm, redeem or surrender. However, like TEW stated, most likely you can check reaffirm and just never sign the reaffirm paperwork.

      One other option might be what our lawyer did, which is instead of checking anything, he just wrote in "Debtors will retain collateral and continue to make payments" for both our car and mortgage. This might not be an acceptable practice in all areas though.
