    My car was towed by the police

    Hi Everyone.

    Ok, I have a BIG mess. My case was dismissed last week for apparently not filing a summary of schedules. I filed them yesterday and the clerk didn't know what to do about a motion to vacate the dismissal so she referred me to my case manager who wasn't there. I went home to get ready for work and went back outside 20 min later to find the police had towed my car for expired registration and parking fines. I know I paid those parking fines so I have to find out why they are attached to my car and also for $200 when they were only $35 tickets. That plus impound fees will cost me at least $600 to get my car back. I just don't have it. I have $400 to my name, $150 is due for my final installment of the bk fees. I get paid on Friday but that still won't be enough to cover my rent which is already late, electric bill that I got a disconnect notice on yesterday AND the impound fees.

    I'm going to take the bus to the courthouse again today to file the motion to vacate but is there anything I can do about the car with the bk? Does the automatic stay affect that?

    And on a final note that really ticks me off. Parked right in front of my car (it's street parking here) is a car that has been abandoned since November. Windows are broken, the side totally smashed in, mirrors broken, etc. It had a pile of tickets sitting on top of it, several neighbors have called the police about it. The officer left that car and took mine. The tow truck driver told me he asked the officer about it and the officer told him to leave it, that it hadn't been there 72 hours! When I called dispatch to ask where my car was taken to I also mentioned the abandoned one - the same officer came back and took the tickets off of it and left it again! Then he towed my next door neighbor's truck for being in the same spot for 72 hours. He's in the navy and was on a two week deployment. There are military ID tags on his truck. Grrrr.

    01/27/09 - case dismissed and closed - 02/24/09 - case reopened and dismissal vacated
    04/01/09 - new 341 scheduled
    6/02/09 - DISCHARGED!!!

    Wonder what he has against towing the abandoned vehicle---maybe he knows the owner?
    So sorry for your situation. I do not have any advice as I am learning also but things will get better!!

      I have no idea. That officer did a sweep on this street yesterday. When I came out I saw his van parked right next to the abandoned car then looked over and saw mine missing. I walked up to the van and he just took off and I was actually chasing him down the street waving my arms and he kept going. I just wanted to know where it was taken to and how much to get it back. Then he returned later to take the tickets off of the abandoned car and tow my neighbor's truck - at the same time leaving a van that has been in the same spot for over a month! Not that I want the van to get towed because it belongs to another hard working person, but why leave that and take the truck that hasn't been in the same spot as long? I hate that I work two jobs, follow the laws, try to be a good citizen and all I am is a "revenue generator"

        I know. I get so frustrated when it seems like you keep getting kicked over and over and all you are doing is trying to do the right thing. Just know that as soon as you get all your paperwork in correctly you are going to get a fresh start.

          Get your the dismissal vacated call the power company and tell them you filed BK so they don't turn your power off.

            Just a note: You are no longer protected by the Stay the moment your case was dismissed.

              Thank you for the advice. I'm taking a cab down now for the motion to vacate. I talked to the parking enforcement and the ticket is not in collections so I can walk there from the bk court, pay $60 (not $200 that the dmv was holding me hostage for) get an abstract to take to the dmv, pay their impound fees and hopefully get my car back tonight.
