    Interesting side not in our UST saga...

    I checked PACER today for the heck of it and it shows that the BKT went ahead with the 341 yesterday (on paper--he needed additional docs and we sent them) and now our case shows "awaiting discharge".

    So since the 341 is over, the UST has 10 days to file presumed abuse, right?

    Just wondering and will check PACER every now & again to see if they do anything before I hear it from my attorney.
    11/18/08 filed CH 7; 341: 12/11/09, cont'd to 01/06/09
    03/21/09 341 hearing for CH 13
    04/27/09 Confirmation hearing for CH 13
    $199/mth for 60 months + $9K 2008 income tax refund

    Yes, 10 days. Occasionally, the UST will file something with the court but it won't get recorded until a few days later.

      Is that 10 days from the first scheduled 341 meeting or from the actual 341 meeting? My 341 meeting was originally scheduled for 12/30/08, but was continued until 1/13/08. On Pacer it still shows the last day for objections as 60 days from the first date scheduled, but I didn't know if it was the same for filing the presumption of abuse motions.

        Since they never have filed presumed abuse on our case it will be interesting to see if (when) they do it. DH says (jokingly) that wouldn't it be funny if they thought they already did it and never file it now. I say we are not that lucky!

        I am also curious if it is 10 days from the original 341 (I assume it isn't or we wouldn't be having the discussion about my UST woes!) or from the continued date.

          We did have a meeting as scheduled, our original 341 was 12/11, continued to yesterday and as long as we provided the docs that the BKT wanted we didn't have to show up in person, he just recorded on tape that the docs were received. That is showing in PACER now, but no presumed abuse by the UST (yet).
