    Hi There, I Need Some Advice. We Had Our 341 On August 2-filed On June 28, I Have A Leased Car. Which We Are Going To Surrender. I'm Behind On Payments And Presently I'm Not Paying Them. I'm Hoping We Get Our Discharge By The End Of October. We Need Our Discharge Papers So We Can Buy A Car. The Bank Hasn't Filed A Relief From Motion Of Stay Yet, So Am I Okay With Still Having The Car? They Can't Come After Me Until They File That, Right?
    Also, When I Notify Them I'm Surrerending The Car Do I Call The Finance Co. Or The Dealership?

    As long as you keep the car insured, you can still drive it.

    If I were you, I would mail the finance company a copy of your statement of intentions (when creditors get notice of your bankruptcy, they do not receive the statement of intentions) along with a cover letter stating that you wish to surrender the car. This will speed up the process of getting rid of the car.

      If I notify them about the car, will they take it from me? That's my only car?
      and what's the statement of intentions? I don't think I saw that before?
