I think you're way overanalyzing this. As long as you're not hiding assets and it isn't a preference (which also would represent assets he could go after) you should be fine. Trustees are human, they've seen this all before.

Maybe you're right and I am over thinking this. But I realize the consequences will be dire, if I file and it's denied. It'll be like throwing me into a pit of crocodiles. The bill collectors will go into a feeding frenzy and rip me apart. I'll think about this, but, if I can wait a year to file and be 99.99% safe, it might be worth the wait. Thanks!

In regards to your question about them not being able to find the new acct. They can and will, they can find it at any institution and "assign and attach" the account, sorry,

If you really do have a judgement, they can find out where you bank or where you work. Take your money out of your account, and go to civil court and tell them you weren't served, file an order to show cause. Go to the courthouse and look at your file, make copies of it, they need an affaidavit to say that you were filed, you weren't, so find out who it was left with, if it was left with anyone. But in the meantime, I would be preparing to file bankruptcy.

Thanks for your replies. I'm thinking about fighting this now, if only to stall, until I can file for bankruptcy.

But once they get a judgment against me, how likely is a levy against my checking account? If I keep less than $100 in it at any time, and if they try to levy for more than that amount, the levy will be refused, since there has to be sufficient funds in the account for the amount of the levy. I don't see them trying to levy for less than $100, since it cost them money to try. So if they try once and it doesn't work, do you think they will keep trying to levy my checking account or give up. But where I can get burned is the $100 levy fee the bank charges. If they keep trying to run a levy through every few months, even if they're getting nothing each time, the bank fees will add up and it won't be worth keeping. BTW, I've already removed the over draft protection, so a levy over $100 wouldn't go through due to the over draft paying for the levy. Thanks!
