    341 on wednesday

    Its almost here. I checked the west tennessee bk court and it says there will be 96 cases held the morning of mine. I have a local creditor that I am worried will show up ( actually a plaintiff in a civil suit for breach of employment contract... basically i worked 1 1/2 years of a 3 year contract and quit. now they want 40 thousand dollars ..)

    any last advice on the 341 before I go? and what can the "creditor" ask me if they do show?

        In a very polite manner, he can question you about the contract. He'll not be allowed to berate you. With a large caseload, the trustee will let him have his say for a few minutes then, tell the creditor to contact his office if he has additional details.
        Unless there is some strong proof of fraud on your part, the creditor will need to file an adverserial proceeding to actually challenege the discharge of that debt.
