If you didn't file jointly, then the trustee cannot touch your wife's portion of the tax refund. The actual amount that is hers would have to be determined (and probably argued over), but they shouldn't be able to touch it.
Just a side note here....If you or your wife owes money to the IRS or state taxes, the government CAN seize your refund. Maybe that doesn't apply to you, but I wanted to mention it.
