Reaffirmation Agreement Never finalized

Ok, I called our auto financial company to ask why we still were not receiving our car bill. We've been paying on time since before we filed.

We signed a reaffirmation agreement.

The financial people said the reaffirmation was never finazlied.

I called my attorney, but the office is closed.

I thought a reaffirmation was mandatroy if you were going to keep a car. Also, if its not reaffirmed it doesn't get reported to our credit right?

Can they take the car away? Even though we are paying?

Even though you signed the reaffirm, unless it is filed with the courts before your case closes, it is NOT official.

That is correct, in most cases they will not report to the credit bureaus (and in some they still don't even if a reaffirm was filed).

Whether or not they will take your car without a reaffirm really depends on state laws. In most states, even though a reaffirm isn't not filed, the lender cannot take your car as long as you remain current
