I received the notice in the mail today from the court about our ch 7. Where it says "presumption of abuse under 11 U.S.C 707(b) it says "the presumption of abuse does not arise". Who wrote that?? Who decided that I mean??

I believe when you pass the means test, then the POA does not arise.
Your means test has a little box that you tick that says the POA does arise, or doesn't arise.
You must have passed the means test!

If this is a notice of filing, this is a statement based on the petition you filed. It's there to inform creditors that the result of the means test you filed does not cause the presumption of abuse to arise. This is a preliminary statement, however, and the status of presumed abuse can change if the case trustee or US Trustee disagrees with your means test.Comment

I didn't think anything would be on Pacer until after the 341, we just filed the 16th? I haven't even registered yet, I guess I should do that then!Comment

When you say keep an eye on pacer, does that mean going beyond last filed? I just bring up that one page and then exit. Should I be going in and checking everything over? I will be so glad when this is over and done.Comment
