341 Done!

I had my 341 today and, thanks to the folks here, I wasn't apprehensive about it at all. I was number 30 of 47 cases. When it was my turn, it took about 3 minutes, I was declared a no asset case, and the trustee wished me good luck. I guess they are pretty backed up with BK's because when the trustee was giving the into speech (what to expect, how to fill out the form she handed out, read info from the other sheet that was handed out), she said that we could expect to receive our discharges in 90-120 days. It doesn't matter how long it takes...I'm just glad it's over!

Mine was yesterday and it was quick and painless. The trustee spent a bit of extra time on a couple of cases, really strange ones.

One guy's ex-wife showed up thinking that he was trying to discharge the child support obligation and she got a bit crazy.

A small town car dealer showed up on this young lady and wanted to seize her 20 year old mini-van even though the dealer never perfected a lien on the title and has lost all the paperwork showing it was pledged to the debt obligation. When the trustee asked the value the dealer said it was worth $3,000!!! Too bad for him the trustee was quick with a laptop and found the Kelly Blue Book value to be $800, then he exempted the property.

One couple had all their paperwork filled out by a lawyer that no one including the Georgia Bar Association has never heard of. The trustee said the paperwork was filled out pretty well but he really needed to get to the bottom of the lawyer situation before he could allow the filing to go on. They had a business card and receipt but when questioned they stated that there was no signage at the law firm's office but it was in a nice building.

After all those fun cases mine was over in seconds.

Bell, that's crazy! At least you had a bit of entertainment. Why in the world would you want to go through all that hassle to take a 20 year old mini-van?

I was worried when I got there because the first two cases were businesses, so I thought it was going to be forever before I even got a chance to go. Luckily, the businesses got a separate trustee.

The first business that got called was STILL there when I got done with mine. I was sitting in the back, but apparently some of his creditors were asking questions about some loan. The owner started to get louder and louder as got more and more frustrated while he was trying to explain the terms of the loan and why he filed BK. That was the only excitement I had.

as it is 60 days that creditors and the trustees can object, once that 60 days is up you are ok.
