    Bankrupcy and mortgage question

    We just had our 341 meeting today and i am confused after reading some of the posts here. We have not signed a reaffirmation agreement with our mortgage company for first or 2nd. We are still running late but not 30 days, I have to western union (can not reach them by phone - always get someones voice mail) payment before the 30th to stay current though. We put in our bk papers that we intend to reafirm, do i need to worry that we have not recieved anything yet??

    Also I was talking with a guy today that is getting his mortgage modified at 3% interest for 3 years then he goes back to 6.25% fully amortized. He is with the same bank as i am. Is it possible to work this now with the bank before i reaffirm?? Or do i need to wait? I do not want to fall behind now again and then have the trustee say that we can not stay in the house now. We just had major loss in income but with the BK we should be straight with everything the next couple months now. It will be tight for a while as my wife is the main earner now.

    Any help would be greatly appreciated.

    i would try to modify before you file (but current). if you can't modify it now, the second choice is to wait until after you're discharged.

      Thank you. We already filed we are just trying to decide what to do. My attorney sugested we quit paying now and save the money as we could stay in the house for 6 months or so. But if we can get a modifaction even if just short term for a couple years and maybe stretch back to 30 years we would be ok. I do not want to have he BK discharges and then end up with a forclosure after the BK is done.

        oh - i didn't know what your desires are. if you want to stay in the home - definitely seek a modification after discharge, and stay current on your mortgage. however, if you intend to walk away, stop making payments and stay as long as possible "rent-free" until they kick you out. save some of that cash though !
