    Depressed

    I am still trying to save for the lawyer and it is really depressing. Something always pops up to eat the money. I have my registration due this month as well as inspection. I am so worried that I will put the money into the car and eventually lose the car with chapter 7. So depressing.

    If I file the chapter 7 and then lose my car I will die.I will not be able to work!

    I do not know what to do. I do not think I could afford a chapter 13 and I know the credit union is not going to let me keep the car since I have read that here.

    I just want the pain to go away!

    Sorry, I have not read your other posts, so I don't know if you provided info.

    Does your state exemption cover the equity in the car? Can you afford the car payment post BK and is the car paid up to date?

    With 78 posts, you should have read enough here to know that you need to plan the BK and set a cash budget for yourself to include saving for the lawyer.

    Once your plan is in motion, you should try to relax and just put one foot in front of the other and do what you have to do.

    If you have stopped paying all your unsecured debt and still do not have enough left in your budget to live, you might want to wait on the BK until you can find a way to generate more income. The BK will do you no good if you are still having money problems after you stopped paying your debt.

    BK should not cause you pain, it should be providing you relief. Make a plan.

      Well I am still paying all of my credit union debts since they will take the car if I am late on their other payments. I have a loan with credit union as well as a credit car besides the car loan. Most people can keep their car but credit unions are different.

      I can afford my car payment but not car payment and the other debts.

      I also got scared into paying another creditor since they kept saying that they would sue. I paid them a chunk less then a month ago and now they are going to sue anyway.

      coming up with 1600 for a lawyer is hard when a persons take home is less than 2k a month. I am just venting here. The stress really can be bad.

      I am also worried about not having a car. I live in the middle of nowhere so no car would mean no job, no groceries and so on.

        It is normal for a creditor to say whatever they have to say to get money from you. They lie. I am not surprised they are suing you anyway after the payment, that is SOP. That is why we say, do not talk to the CA's.

        As to the car, you CAN keep your car if it is financed with a CU. You can reaffirm the car and not reaffirm the rest. You can have the cross collateralization removed at the time of reaffirmation (not before). I did this and still have the car that is financed with the CU. I reaffirmed it because it was best for me (its the car my husband drives). Don't get it in your head that CU's will not negotiate - it simply is not true. Each lender is different and has a different set of criteria for negotiating. A lot of people just gave the car back without even trying to work it out with the BK dept.
