    Hearing scheduled

    We have our hearing scheduled for the end of March, telephone hearing. We have to redo our means test before that and the trustee says we are close and she will take another look at the numbers.

    My lawyer says go ahead and do our tax return. We informed him that my husband got a big bonus after we filed. He doesn't seem to be worried about that. We also are going to get money back from our tax return. What should we do with this money? We are afraid to spend it. Should we hide it under our mattress? Ha. Maybe put it on a gift card? I'm not sure if they will even look at that at this point. We are an assumption of abuse case and motion for dismiss was filed for 707.

    the trustee will most likely take your tax refund unless you have an exemption to cover it. the bonus belongs to you. It's post filing. the taxes are an asset that you were sending to the IRS before you filed

      What if we spend it? My hearing isn't until March. Do they make you come up with the cash? I'm not sure what our exemptions are, as our lawyer's office did all the schedules. At our 341 trustee asked if we would get the same amount back this year and we said we did not know. But I did hear her say to other people (at their 341) that she was going to take some of their tax refund. She never said that to us.

        If I were you, I'd hang on to the money. With a UST motion to dismiss on the table, you should hope for the best (the UST drops the motion) but be prepared for the worst (your case gets dismissed).
