    If the trustee wants all the apt fridges/dishwashers...

    I just got a note from my atty saying this (I'm calling him today)
    -We couldn't exempt about 700 of the tax return so he'll probably want that.
    -We couldn't exempt the Refrigerators/Dishwashers in the apts (I'm surrendering) so he'll want that.

    I don't care about those appliances and don't mind if the trustee gets them. my question is this:

    Do *I* have to spend 2 days of MY time, (and MY money to rent a truck/trailer) unhooking this crap and delivering it to that jerk...or can I just mail him a key and say "have a nice day"?

    Also, if I have to do the legwork, can I argue some of that 700 bucks is my cost to do it?

    HArd to beileve a trustee would want used appliances but, you just have to make them available to whomever the trustee send to collect the property. It's all on his dime.

      They wont take them... I would not worry about it.

        If the trustee would actually take them (unlikely), you just have to unlock the door.

          What district in Michigan are you in? The lawyers I spoke with told me that in the eastern district there is a 2k rule. Basically that means the trustee will not waste his/her time with anything worth less than 2k due to the costs expended on recovering, marketing, and selling the property. I have a project boat that is currently only worth about 1k, he told me not to waste any of my exemptions on it, as the trustee will not want it anyway. If the trustee asks about the appliances, ask the trustee when they would like to pick them up. Odds are they won't unless the current value is over 2k.
