Hello all! What a great forum. I am preparing to file pro se but have a question about timing in CA. I've read and read posts but cant seem to nail this one down.
Is the redemption period (three months from NOD until sale date set) paused while the bk happens until either discharge or relief of stay?
In other words: NOD filed 2/27. So with no bk, the sale date could be set 5/27. But if i file now, and lets say for example they get a relief of stay in 30 days, does that push the redemption period (and therefore the setting of the sale date) to 6/27 instead? Or does this three month period occur alonside the bk process and is not affected by the relief of stay (since technically there is no action against me).
I'm just wondering if its better to wait for the sale date to be set before filing, or if it doesnt matter because the end result would be the same. I'd rather not wait, just for the record (but need more time at the end)
Thanks all!
edit: sShould have mentioned that I will be surrendering the house in the bk, and will be a no asset case.
