    Paging All Gurus!

    Ok quick recap

    filed pro se, case was dismissed due to missing summary, summary was filed with a motion to vacate dismissal, case auto-closed the day after the last day of objections to motion to vacate. Motion to reopen was filed and granted along with the motion to vacate the dismissal. Everything needed was filed including the debt ed cert.

    On a side note I was contacted by the BK court last week to inform me that I was due a refund of reopening fees $260 because it was due to admin error that my case was closed in the first place. Yay!

    Back to the topic... My last day for objections is March 9th and I have been sent a notice of an amended 341 meeting for April 1. The date for objections has not been changed even though the new 341 is nearly a month later.

    So here is the question... which paystubs do I bring to the new 341? The 6 months prior to the filing date or 6 months prior to the new 341? I just moved two weeks ago from San Diego (where I filed) to Los Angeles. I have a file folder of bk stuff that has everything up to the original 341 meeting in January. Anything that I've gotten since then, I have no idea where it is since I'm swimming in a sea of boxes right now.

    Also, the transfer to the new city comes with a somewhat significant pay raise which still puts me slightly under the new median income rules (but not what they were when I filed in December) That won't show until the paystub RIGHT before the new 341. It will also give me disposable income which I didn't have before.

    So my two questions are: 1) which pay stubs do I bring? 6 months prior to filing or 6 months prior to 341? 2) will the pay increase though still under the median but changing the disposable income of the original means test affect the 341 outcome?

    I'll also note that from what I can see in PACER and from my conversation with the person who told me they are giving me a refund of fees, my case is also "auto set" for discharge and they are eager to close it out.

    01/27/09 - case dismissed and closed - 02/24/09 - case reopened and dismissal vacated
    04/01/09 - new 341 scheduled
    6/02/09 - DISCHARGED!!!

    If you cannot find your pay stubs, go to your HR or payroll person and ask for a printout. If at question of any records, bring them all, act confident and look like you are prepared for any question. Your demure has a lot to do with what questions if any arise. 'Hub

      Morning!

      I had the same question when I was dismissed.

      I am pretty sure the answer was you go off your original pettion date filing and the six month look back is from your original date of filing. So you would probably bring whatever you would have brought to the original 341.

      I thought I might have to re-do all my schedules and figures, but I believe everything stays the same.

      I have to leave for work in a bit, but look through my posts and see if you can find the post I made soon after I was dismissed, the answer might be there.


      Although you may have to answer "yes" to the "has anything changed since you filed question", if asked.

      Wish I had a more definitive answer for ya.

      Gurus should chime in soon, hopefully.

        All deadlines and requirements go off your original filing date and the date of your "originally scheduled" 341 meeting.
